EMPLOYEE STRESS

Is your company vulnerable to a claim for damages due to stress?
Is your company vulnerable to an enforcement notice from the HSE?

If an employee is off work due to diagnosed stress, then you should accept that stress has been identified as a potential work-related health hazard within you workplace. You must undertake a stress risk assessment as you may have to prove that you have taken reasonably practicable measures to minimise the health risk from stress within your workplace.


IMPORTANT

Have you undertaken a Stress Risk Assessment in accordance with The Management of Health and Safety at Work Regulations?

All employers with five or more employee have a legal duty to undertake stress risk assessments. Consider this statement from the Health and Safety Executive:

“An organisation that undertook a risk assessment based on the approach in HSE's current guidance (HSG218 Tackling work-related stress) and identified major problems/issues, would be unlikely to be subject to enforcement action by HSE provided it could demonstrate it was taking steps to address those problems/issues.”
